These Terms and Conditions (“Terms”) govern your use of emxcentrals.com (the “Site”) and any purchase you make from EMX Centrals (“EMX Centrals,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to purchase from EMX Centrals. We sell to customers located in the United States.

2. Products and Descriptions

We sell electric dirt bikes and electric motorbikes, including Surron and Talaria models, along with related parts. We work to show accurate model years, specifications, colors, and photos. Colors may look slightly different on your screen, and manufacturers may update specifications without notice. If a product you receive is not as described, your remedy is set out in our Return and Refund Policy.

3. Pricing and Availability

  • All prices are listed in US dollars (USD).
  • Applicable sales tax and shipping charges are shown at checkout before you pay.
  • Products are subject to availability. If an item you ordered is unavailable, we will notify you and offer a full refund or an alternative.
  • If a product is listed at an incorrect price due to an error, we may cancel the order and refund you in full, even after confirmation.

4. Orders

Your order is an offer to buy. We accept it when we confirm your order and process payment. We may refuse or cancel an order for reasons including suspected fraud, pricing errors, or inability to verify payment or shipping information. If we cancel after you have paid, you receive a full refund.

5. Payment

We accept the following payment methods:

  • Credit and debit cards
  • PayPal
  • Apple Pay and Google Pay
  • Bank transfer, Zelle, and Chime

Orders paid by bank transfer, Zelle, or Chime ship after the payment is received and confirmed. You agree that the payment information you provide is accurate and that you are authorized to use the payment method.

6. Financing

Financing is available on bikes in stock with a $350 down payment. All financing is subject to credit approval. Your monthly payment and term depend on the bike you choose and your approval. Submitting a finance application does not guarantee approval.

7. Shipping and Delivery

  • Service area: we ship within the contiguous 48 United States. Contact us before ordering for delivery to Alaska or Hawaii.
  • Processing time: 1–3 business days after payment is confirmed.
  • Transit time: typically 3–7 business days, depending on your location.
  • Carriers: bikes ship with a major carrier such as FedEx, UPS, or a freight carrier. You receive a tracking number by email when your order ships.
  • Assembly: bikes may arrive partially assembled with instructions for final setup.

Delivery times are estimates and may be affected by carriers, weather, or other events outside our control. Report any shipping damage within 7 days of delivery as described in our Return and Refund Policy.

8. Returns and Refunds

We offer a 30-day return window from the date of delivery. Conditions, fees, and refund timing are explained in our Return and Refund Policy, which is part of these Terms.

9. Limited Warranty

Bikes sold by EMX Centrals include a limited warranty of 2 years on electrical components and 1 year on other components from the date of delivery, covering defects in materials and workmanship under normal use. The warranty does not cover normal wear items (such as tires, brake pads, and chains), crashes, misuse, racing, unauthorized modifications, improper maintenance, or water damage from submersion. To make a claim, email info@emxcentrals.com with your order number, photos, and a description of the problem.

10. Rider Safety and Legal Use

Electric dirt bikes are powerful vehicles. You are responsible for:

  • Wearing proper protective gear, including a helmet, every time you ride.
  • Following all federal, state, and local laws, including rules on registration, licensing, age limits, and where off-road vehicles may be ridden.
  • Riding off-road models only in areas where they are permitted. Unless a model is sold as street legal, it is intended for off-road use only.
  • Supervising any rider under 18 and following the manufacturer’s age and weight guidance.
  • Charging, storing, and maintaining the battery according to the manufacturer’s instructions.

11. Use of the Site

You agree not to misuse the Site, including by attempting to gain unauthorized access, interfering with its operation, submitting false information, or using it for any unlawful purpose.

12. Intellectual Property

The Site’s content, including text, graphics, logos, and layout, belongs to EMX Centrals or its licensors and may not be copied or used without permission. Surron and Talaria are trademarks of their respective owners.

13. Disclaimer

Except for the limited warranty described above and rights you have under law, the Site and products are provided “as is” and “as available.” To the extent permitted by law, we disclaim other warranties, express or implied.

14. Limitation of Liability

To the fullest extent permitted by law, EMX Centrals is not liable for indirect, incidental, special, or consequential damages arising from your use of the Site or products. Our total liability for any claim related to a purchase will not exceed the amount you paid for that product. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to hold EMX Centrals harmless from claims arising from your misuse of the Site or products, your violation of these Terms, or your violation of any law.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of California and applicable US federal law. Before filing any claim, please contact us so we can try to resolve the issue informally. Any dispute that is not resolved informally will be handled in the state or federal courts located in California, or in small claims court where eligible.

17. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with a new effective date. The Terms in effect at the time of your order apply to that order.
